Pictometry Wins Patent Infringement Lawsuit Filed by GeoSpan

ROCHESTER, N.Y., April 6, 2011 /PRNewswire/ — Pictometry International Corp., the leading provider of aerial oblique imagery and measuring software, announced today that the United States District Court of Minnesota has summarily declared that Pictometry’s oblique aerial image capture system does not infringe on GeoSpan’s patent.
“For Pictometry customers and the industry at large, this ruling confirms Pictometry’s integrity and innovation — the very attributes that enabled us to establish the aerial oblique industry more than a decade ago and the same attributes which have enabled us to maintain our leadership role in the geospatial industry ever since,” said Rick Hurwitz, Pictometry’s Chief Executive Officer.
According to Court documents, the Court ruled in favor of Pictometry in the patent dispute and entered a Declaratory Judgment of non-infringement on GeoSpan’s U.S. Patent no. 5,633,946, effectively ending the case. Due to the baseless nature of GeoSpan’s infringement claims, Pictometry may ask the Minnesota Court to declare the case “exceptional” and require GeoSpan to reimburse Pictometry for attorney’s fees and costs incurred in defending against such claims.
In a related matter, the United States Patent and Trademark Office granted Pictometry’s request to re-examine the GeoSpan patent to consider written materials which were not before the Patent and Trademark Office examiner when the initial examination of the patent was made. According to the Patent Office’s initial findings, there are substantial new questions of patentability that may evidence inequitable conduct on the part of GeoSpan for withholding some of these materials from the Patent Office.
“Pictometry will continue to protect its intellectual property on behalf of its customers as we create new, innovative technologies and partner with them to better serve their needs,” said Stephen Schultz, Pictometry’s Chief Technical Officer.

Kathryn Hester Featured in Article on Entrepreneurial Opportunities
Posted Aug 1, 2011 at 18:00 pm See MoreKathryn Hester, Ph.D., a patent agent at Dunlap Codding is featured in the April 3, 2011, issue of The Oklahoman in an article by Paula Burkes, “Entrepreneurial Opportunities Lure Aspiring Doctors, Chemists from Research to Startups.”
Kathryn used her doctorate in biochemistry and microbiology to become a patent agent, after passing the patent bar exam. She said, “to correctly write patent applications, you need to understand the invention to be able to critique and analyze it.” Hester meets with inventors, writes applications and reviews invention disclosures. As she told The Oklahoman, the process of obtaining a patent application involves the preparation and submission of a patent application to the Patent Office, followed by “prosecution” of the application. Prosecution essentially involves arguing back and forth with the Patent Office on why the applicant believes the invention is novel and non-obvious (i.e., involves an inventive step) over what’s previously been published, patented or otherwise disclosed. Typically the biggest hurdle in obtaining a patent is arguing the non-obviousness of the inventive concept, as it can be very subjective.
The article profiles other inventors and scientists, including Dunlap Codding clients, who have started companies or otherwise used their degrees outside the realm of research and academia.

Oklahoma Bioscience Leaders Point the Way for the Next Generation
Posted Mar 1, 2011 at 18:00 pm See MoreDunlap Codding Patent Agent Dr. Kathryn Hester was quoted in April Wilkerson’s article in The Journal Record on March 31. According to the article,” the beauty of the bioscience industry is that a person can move from pipettes to patents if stagnation sets in.”
Dr. Hester is quoted on the path she took to protect innovations. ”My path has been pretty straightforward with a crook in it. I went straight from the Ph.D. to work for the law firm. I knew when I was doing my graduate work that I didn’t want to stay in a lab for the rest of my life, but I wasn’t sure exactly where I wanted to go. Patent law is an interesting area of the law in that it does not require a law degree to practice it. It actually requires a technical degree because you need to be able to understand what the inventions are and to be able to critically analyze them and to write patents correctly.”
The article continues, profiling other University of Oklahoma graduates and scientists.

Oriana Hawkins Receives Oklahoma BioScience Travel Award
Dunlap Codding is a pleased to be once again a contributor to the Oklahoma BioScience Travel Award presented at the Graduate Research Education and Technology Symposium. The 2010 award has been given to Ph.D. candidate Oriana Hawkins. She is a student in the Department of Microbiology and Immunology at the University of Oklahoma, mentored by Dr. William Hildebrand.
Dr. Hildebrand’s lab works to understand how the body’s alarm system, HLA, alerts the immune system to diseases such as cancer, HIV, and West Nile Virus. Hawkins has focused her energies on identifying new targets for breast cancer. The long term goal of her project is to develop T cell eliciting vaccines and antibody therapeutics to treat breast cancer. She is co-inventor on three patent applications related to her research; the applications were prepared and filed by Dunlap Codding.
Ms. Hawkins was selected to receive the Oklahoma Bioscience Travel Award for her presentation, “Targeting of Breast Tumors by an HLA A*0201/MIF Specific Antibody.” The award is part of the Graduate Research Education and Technology Symposium held annually at OUHSC. The award provided funds for travel expenses and registration fees to attend the BIO International Conference held in Chicago in 2010. BIO is the world’s largest annual event for the biotechnology industry.
While at BIO, Ms. Hawkins learned the business of bringing new therapeutic agents from discovery, to clinical trials, through FDA approval and, finally, to market. She made contacts within three large pharmaceutical companies which could significantly propel the development of her discoveries toward new cancer therapies.
“The opportunity for Oriana to network with scientists and business investors as a graduate student was a unique and eye-opening experience,” according to Douglas Sorocco, Dunlap Codding shareholder and adjunct faculty member in the Department of Physiology at the University of Oklahoma Health Sciences Center. “While many students see the academic importance of their work, few have the resources necessary to network with business leaders and investors at a conference like BIO so early in their careers. We are delighted to have made that opportunity available to Oriana and to other young scientists.”
Dunlap Codding was also a contributing sponsor of the Oklahoma booth at BIO, and a delegation from the firm, led by Dr. Kathryn Hester, helped to staff the booth in Chicago. The firm is a charter member of the Oklahoma Bioscience Association and supports the efforts of private and public sectors to grow the bioscience industry in Oklahoma.
