Case Book of Domain Decisions Published

The Register reports WIPO publishes case book of domain name decisions.

The World Intellectual Property Organization has published some useful information for anyone involved in domain name disputes.

All decisions under the Uniform Domain Name Dispute Resolution Policy (UDRP) are available online. However, the addition of an overview for interpretation is a useful resource.

The overview of WIPO panel views on selected UDRP questions provides answers to questions, such as:

Can bad faith be found if the disputed domain name was registered before the trademark was registered/common law trademark rights were acquired? Answer

Is the content of a web site relevant in determining confusing similarity? Answer

Does a trademark licensee or a related company to a trademark holder have rights in a trademark under the UDRP? Answer

What deference should be owed to past UDRP decisions dealing with similar factual matters and legal issues? Answer

The format of the overview is much like a treatise, with citations to support the statements. A useful website for anyone involved in, or thinking of becoming involved in a domain name dispute.
