APPLE LOSES CHINESE TRADEMARK FIGHT: ROUND ONE

BEIJING: Apple Computer Inc has launched legal action against the trademark appraisal committee of China’s State Administration for Industry and Commerce, after an application to register its trademark “apple” logo (blue apple on left) for a clothing/apparel line was rejected, the China Daily reported.  The committee rejected the application in June, 2003, saying that Apple Computer’s logo is similar to a clothing trademark registered by Guangdong Apples Industrial Co (red apple on right).  

Apple sought to have its mark judged “famous” so as to override Guangdong’s use and registered trademark — a use claimed to be an infringement by Apple.
